Ten80 Rentals Ltd t/as Ten80 Holidays General Terms and conditions, booking conditions and Terms of Payment.
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date and between the undersigned person(s) or company (the “Guest”) and Ten80 Rentals Ltd t/as Ten80 Holidays (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
To reserve the property the Guest should sign this contract and pay a deposit of 30% of the Total Rental Fee. On receipt of payment, the Rental Agent will then forward confirmation of the booking to the Guest. The Property is offered for hire subject to confirmation by the Rental Agent to the Guest.
The Guest agrees that no more than the stated or advertised Maximum Capacity of persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon the Guest under this Agreement.
Assignment or Sublease
The Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
The balance of the Total Rental Fee is payable 30 days before the start of the Rental Period. If payment is not received, the Rental Agent reserves the right to give notice in writing that the reservation is cancelled. Reservations made within 15 days of the start of the Rental Period require the Total Rental Fee to be paid at the time of reservation.
Flights & Transfers
The cost of flights and airport transfers are not included within the Total Rental Fee.
The services included are only those listed on your invoice.
Check-in and Check-out times
Check-in is available from 16:00hrs on the day of arrival and check-out must be completed before 10:00hrs on the day of departure unless otherwise agreed.
Your Total Rental Fee does not include travel insurance. We strongly advise that all members of your party have the appropriate travel insurance in place prior to travelling.
Changing your booking
If you wish to make alterations to your reservation after the Agreement is formed, we will seek to accommodate your request where it is reasonable to do so. Such changes are at the sole discretion of the Rental Agent.
Risk of Loss and Indemnification
The Guest agrees that all private property, furnishings, personal effects and other items brought into the Property by the Guest or their permitted guests and visitors shall be at the sole risk of the Guest with regard to any theft, damage, destruction or other loss and the Rental Agent shall not be responsible or liable for any reason whatsoever.
The Guest hereby covenants and agrees to indemnify and hold harmless the Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs or legal fees incurred by the Guest, permitted guests, visitors or agents, representatives or successors of the Guest due to any claims relating to the destructions of the property or injury to persons or loss of life sustained by the Guest or family and visitors of the Guest in or about the Property and the Guest expressly agrees to save and hold the Rental Agent harmless in all such cases.
The guest hereby waives and releases any claims against the Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by the Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. The Guest agrees to use any such facilities or amenities entirely at the Guests own initiative, risk and responsibility.
Entry and Inspection
The Rental Agent reserves the right to enter the property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons.
The Property does not allow smoking indoors. If smoking is found to be evident then a charge of up to €500 for professional cleaning may be levied.
Pets are not allowed in the Property unless specifically agreed in writing by the Rental Agent.
Unavailability of the Property
In the event that the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of the Rental Agent, the Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy, capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, the Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and the Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to the Agreement.
Cancellation by the client
If the Guest chooses to cancel the reservation, the Guest must notify the Rental Agent in writing. The date of cancellation shall be the date that the cancellation letter or email is received and acknowledged by The Rental Agent.
Bookings confirmed after the 29th July 2020 for holidays to be taken after 1st August 2020 have cancellation protection. Thereafter, for cancellations made from 60 days up to 2 days before check-in date, the Rental Agent will refund in full any payment made by the Guest . Cancellations made 2 days or 1 day prior to or the day of check-in will not be eligible for refund. Example: For a check in on Saturday, Guests could cancel up to Wednesday, but not Thursday (2 days prior) or Friday (1 day prior) or Saturday (day of check in).
Bookings for which the bookings dates are changed or rescheduled are classified as modifications and will not be considered eligible for cancellation claims.
Due to each Accommodation having different Owners it is not possible for the Guest to exchange one Accommodation for another without charges being incurred in respect of any such new Accommodation and a new Booking being completed.
Refunded Payments for cancelled Bookings will be released back to the Guest within 14 working days of the scheduled date of check-out of the original booking.
