Ten80 Rentals Ltd t/as Ten80 Holidays General Terms and conditions, booking conditions and Terms of Payment.
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date and between the undersigned person(s) or company (the “Guest”) and Ten80 Rentals Ltd t/as Ten80 Holidays (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
To reserve the property the Guest should sign this contract and pay a deposit of 30% of the Total Rental Fee. On receipt of payment, the Rental Agent will then forward confirmation of the booking to the Guest. This deposit is non refundable apart from specific COVID policy listed below. The Property is offered for hire subject to confirmation by the Rental Agent to the Guest.
The balance of the Total Rental Fee is payable 7 days before the start of the Rental Period. If payment is not received, the Rental Agent reserves the right to give notice in writing that the reservation is cancelled. Reservations made within 7 days of the start of the Rental Period require the Total Rental Fee to be paid at the time of reservation.
Flights & Transfers
The cost of flights and airport transfers are not included within the Total Rental Fee.
The services included are only those listed on your invoice.
Check-in and Check-out times
Check-in is available from 16:00hrs on the day of arrival and check-out must be completed before 10:00hrs on the day of departure unless otherwise agreed.
The Property does not allow smoking indoors. If smoking is found to be evident then a charge of up to €500 for professional cleaning may be levied.
Pets are not allowed in the Property unless specifically agreed in writing by the Rental Agent.
The Guest agrees that no more than the stated or advertised Maximum Capacity of persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon the Guest under this Agreement.
Assignment or Sublease
The Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
Your Total Rental Fee does not include travel insurance. We strongly advise that all members of your party have the appropriate travel insurance in place prior to travelling.
The guest is responsible for ensuring that he has adequate and fully comprehensive household and third party liability insurance in line with its intended use.
Changing your booking
If you wish to make alterations to your reservation after the Agreement is formed, we will seek to accommodate your request where it is reasonable to do so. Such changes are at the sole discretion of the Rental Agent.
Cancellation by the client - Applicable to all bookings for dates until the end of the Winter 2022/23:
If the Guest chooses to cancel the reservation, the Guest must notify the Rental Agent in writing. The date of cancellation shall be the date that the cancellation letter or email is received.
A deposit of 30% is required to confirm and secure a booking with the remainder due 7 days prior to arrival.
This deposit is non refundable under any circumstances apart from specific COVID policies listed below.
7 days prior to arrival you can decide to:
- Border or travel restrictions
- Lock down in either the country of your departure or in France
- Quarantine in either the country of your departure or in France
- Illness to members of the travelling party
If you do not choose to proceed with your booking for any other reason then the 30% deposit is non refundable.
Proceed with the booking in which case you will need to pay the remainder.
This is then non refundable for any other reason apart from the specific Covid cases lifted above.
For all cancellations made after 7 days before arrival (due any of the COVID related reasons listed), Ten80 will offer you a credit note of the same value that can be used at any time within the following 18 months in any of our properties and/or for any of our services.
For all last minute reservations made 7 days before arrival - the full amount needs to be paid and is non refundable.
Cancellation by the owner
The owner may, in exceptional circumstances, be required to cancel the reservation. In this case, a full refund of all monies paid will be made to the Guest.
Upon arrival, a security deposit payment form is required with a valid credit card.
Risk of Loss and Indemnification
The Guest agrees that all private property, furnishings, personal effects and other items brought into the Property by the Guest or their permitted guests and visitors shall be at the sole risk of the Guest with regard to any theft, damage, destruction or other loss and the Rental Agent shall not be responsible or liable for any reason whatsoever.
The Guest hereby covenants and agrees to indemnify and hold harmless the Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs or legal fees incurred by the Guest, permitted guests, visitors or agents, representatives or successors of the Guest due to any claims relating to the destructions of the property or injury to persons or loss of life sustained by the Guest or family and visitors of the Guest in or about the Property and the Guest expressly agrees to save and hold the Rental Agent harmless in all such cases.
The guest hereby waives and releases any claims against the Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by the Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. The Guest agrees to use any such facilities or amenities entirely at the Guests own initiative, risk and responsibility.
Entry and Inspection
The Rental Agent reserves the right to enter the property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons.
Unavailability of the Property
In the event that the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of the Rental Agent, the Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy, capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, the Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and the Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to the Agreement.
